Floral Industry Legislative Issues - Employee Free Choice Act

The Employee Free Choice Act (EFCA), also known as "card check," was one of the key issues SAF members lobbied against on Capitol Hill during Congressional Action Days. Labor's number one priority to make it easier to form unions did not pass during the first 100 days. Now supporters of EFCA are talking "reasonable" alternatives to card-check and binding arbitration. Why is this a sheep in wolf's clothing?

Remember that supporters need just 60 votes in the Senate. If they get 60 votes on a compromise bill (cloture), EFCA supporters can then simply insert binding arbitration as an amendment on the Senate floor. Or they can wait until the conference committee with the House to make changes they want and bingo, they have dropped the compromise and achieved their goal. Also remember the House can pass EFCA as is whenever Speaker Pelosi (D-Calif.) chooses to do so.

Sen. Arlen Specter switched parties last week getting the Democrats closer to a 60 vote filibuster-proof majority, but Specter said in his statement that he opposes EFCA and will vote "no" on cloture as well. But now that he is a Democrat, unions in Pennsylvania area already working hard to get him to support EFCA. So folks in Pennsylvania -- please vocalize your opposition to EFCA and any compromise alternatives!
