Employee Free Choice Act
SAF opposes the Employee Free Choice Act (EFCA) (H.R.1409, S.560). SAF believes that private ballot is the best way to allow workers to vote their conscience on whether or not to join a union. The bill, as written, could create an atmosphere during the union organizing process that would allow those who support the formation of a union to coerce employees into signing the card authorizing the union. The process could be open to bullying and deceptive tactics, and the authorization cards could be susceptible to fraud through forged signatures.

The bill could make small businesses much more vulnerable to being organized against their will because of the low cost and resources of a car check campaign. President Obama made passage of this legislation one of his campaign promises. Recently EFCA has become a hot issue in the Senate where the fight will occur.

Sen. Arlen Specter (D-PA), the only senator to vote for passage in 2007, came out against this version of the bill citing the negative effects it will have upon business in the recessionary climate. Specter was seen as the swing vote as Democrats look to bring the bill to the floor.
