Floral Industry Legislative Issues - Labor and Workers Rights

The Internal Revenue Service is offering a free nationwide conference call on May 20, 2009 for small business owners and industry professionals. This conference call will focus on proper work classification standards for employers.

In order to participate in the call, you must register by tomorrow, Friday, May 15 here. Topics that will be covered include employee vs. independent contractor classification, worker classification-related forms, and Section 530 relief requirements.

EFCA Stalled but Still Alive PDF Print E-mail
Floral Industry Legislative Issues - Employee Free Choice Act
Passage of the Employee Free Choice Act (EFCA) is a near certainty in the House, but the real battle will be in the Senate.  All 40 Republican senators are opposed to EFCA, meaning that the remaining 60 senators would need to vote to cut off debate and move toward a final vote.

It's pretty clear now that some type of compromise version of the bill will be considered in the Senate.  At this point, no one expects the bill in its current form to reach President Obama's desk.

What's a compromise look like?  No one knows for sure, but here's what we're hearing:

  • The secret ballot requirement is likely to be retained, but some proponents are proposing an expedited election format.  Among the ideas is one to require an election be held with in 10 days of the filing of signed authorization cards from a majority of employees.
  • Another proposal, called "postcard check," would allow employees to mail their authorization cards directly to the National Labor Relations Board thereby eliminating the potential for intimidation by either management or labor.
  • Some proposals center around giving organizers more access to the workplace. One proposal would require employers to give unions equal opportunity to make announcements, display signs and distribute literature in the workplace.

So far, none of these proposals has gained much traction, and the Senate still has not announced any timeframe for when EFCA will be considered.

And as the year moves on, some members of Congress will begin thinking about the 2010 elections, and labor will be looking at who does and does not support EFCA. For those lawmakers looking to vote for a pro-labor bill, some type of compromise will be attractive.

SAF supports an employee's right to a secret ballot election and opposes EFCA because of government mandated binding arbitration that would increase costs and straightjacket employers with wage levels and working conditions that will make them uncompetitive.buck_photo

125th SAF Convention Right Around the Corner PDF Print E-mail

It feels like just yesterday we were wrapping up SAF's Congressional Action Days in March and now we are packing up to head west. The 125th Annual SAF Convention is just about three weeks away and what an exciting time this is not only for the SAF staff, but for our members who will be joining us out in Phoenix.

You can qualify me as a "first timer" because this will be my first convention I have attended. I'm looking forward to meeting numerous floral industry members as well as getting to talk about some of the grassroots lobbying our members in done in the past couple of weeks. Hosting an event at your business or meeting your congressman in your community establishes a connection that we here in Washington DC can't compare with.

Registration for the SAF Convention is still open but it is getting filled up quickly, and I'm still gathering players for the SAFPAC golf tournament. Join other floral industry members for 18 holes on a great course while aiding SAF's legislative efforts at the same time. Check our the golf tournament page for more information.

The immigration debate went for a wild ride this week in the Senate. We had multiple amendments passed by voice vote without holding a Roll Call vote. Look for more information on this process in Week in Review this afternoon.

AgJOBS also added two more co-sponsors in the House this week. Reps. Steve Rothman (D-9-NJ) and Jerry McNerney (D-11-Calif.) both signed onto the legislation.

After almost two years of push and pull, Kathy and Ken Sanner of Perry Hall Florist in Perry Hall, Md., were able to celebrate the passing of a deceptive advertising law in their state. Gov. Martin O'Malley signed the measure on April 14, but the deceptive advertising law was one of 400 that took effect Oct. 1.

It took a disgruntled customer for the Sanners to even realize deceptive ads were a threat. In 2004 a regular customer told them she had received from a friend an arrangement that was not up the quality standards she expected from Perry Hall Florist. They learned that the friend had ordered from a business with a similar name, but actually located out of state.

"We take great pride and care in making sure that our arrangements are not only professionally designed, but also made with premium fresh flowers, and this arrangement didn't resemble our work," Kathy Sanner said after taking one look at it.

After a couple of months of investigating, the Sanners thought the deceptive business had left their area. But three years later, the same advertising and listing returned to their local telephone directories. When they aired their frustrations at a local business association meeting in November 2007, state Sen. Kathy Klausmeier was in attendance. She approached them that night and vowed to look into passing a bill to halt these deceptive advertising practices.

Klausmeier introduced the bill, S.B. 10, on July 11, 2008. It was approved by the state Senate in April by a vote of 37-6. And the state House passed a similar bill by unanimous vote, which O'Malley signed into law.

"I don't believe that we would be in business today if it wasn't for Senator Klausmeier getting this bill passed," Kathy Sanner said.
